- Mens rea is an old common law standard; intent must be proved for a murder (as opposed to manslaughter) conviction.
- Due process is not a modern leftist construct but an ancient "civil liberty" which is part of our authentic heritage.
What about it is worth violating in this case?
I believe in due process, and I am not advocating that it be violated. However, it will be found that their jail cells looked out over a fire station and that will be considered cruel and unusual punishment. Or a police officer gave them looks of disgust. Or they were drug addicts and should not be held responsible for their crimes. Or an officer asked them, "What happened," before they were given their rights. Or society is only going after them for their sexually activities. Or the children are better off dead than living in such extreme poverty, etc. etc. etc.
